Health and Safety
Employers owe a number of wide-ranging duties within sections 2 to 3 of the Health & Safety at Work etc Act 1974 ("the Act"). Employees, persons in control of premises and manufacturers are also subject to regulation, with duties and responsibilities explicitly defined by the Act.
The health and safety regime provides for the introduction of governing regulations, contravention of which may result in an offence being committed. Health and Safety Executive ("HSE") inspectors enjoy wide powers, and can issue improvement or prohibition notices, and in certain circumstances where there has been a fatality, the law allows for the prosecution of individuals and corporate bodies for manslaughter.
