      <content:encoded><![CDATA[<p><strong>The Guardian Newspaper has again reported on the case of Lotfi Raissi, the first person arrested after the 9/11 attacks. The report describes how previously unseen documents prove that British prosecutors failed to disclose crucial evidence to the courts, resulting in Mr Raissi's detention for five months.</strong></p>

<p>Lotfi Raissi is being represented by Jules Carey of Tuckers, who is quoted as saying,</p>

<p>The court of appeal pulled no punches in asserting that there was a considerable body of evidence to suggest that the Met and CPS were responsible for serious defaults that resulted in Raissi's detention at Belmarsh.</p>

<p>These documents demonstrate, unequivocally, that the blame lies with the British authorities. He has waited seven years for an apology and watched four home secretaries come and go without receiving it. He is hopeful that his wait is finally up.</p>

      <title><![CDATA[Mohamed Raissi was falsely imprisoned]]></title>

      <content:encoded><![CDATA[<p>Mohamed Raissi is the brother of Lotfi Raissi who was wrongly accused of training the 9/11 hijackers. The Court of Appeal confirmed in February this year that Lotfi was “completely exonerated” in a strongly worded judgement that was critical of the part played by the Crown Prosecution Service and the Metropolitan Police in the failed attempt to extradite him.</p>

<p>Like Lotfi, Mohamed, his wife and daughter were awoken by police officers pounding on his door in Hounslow at 3.00am. He opened his door to a team of police officers who immediately arrested him for involvement in the 9/11 terrorist attacks in the US. Mohamed was told to undress and put on a forensic white suit before he was handcuffed and led out to an unmarked police car. He was driven to Paddington Green Police station where he was held incommunicado and detained for approximately 42 hours before being released without charge.</p>

<p>The Court of Appeal considered the reasons given by the Metropolitan Police to justify the arrest and ruled that “they amount only to the fact that he and Lotfi were close brothers, that they lived not very far apart and that each had access to the other’s house. In our judgment, that was not enough”. The arrest was therefore unlawful.</p>

<p>The family’s solicitor Jules Carey of Tuckers Solicitors stated that the amount of damages Mohamed would receive from the Commissioner had not yet been determined. Mr Carey stated that he hoped a sum could be agreed so as to avoid further litigation in this case.</p>

<p>Mohamed said “I feel very relieved that this ordeal is almost over. We lost a lot, not just my freedom. My wife lost her job with Virgin Airlines when I was arrested and my health and our family life were put under terrible pressure. I hope a line is drawn under this chapter soon so that we can all move on”.</p>

      <title><![CDATA[High Court Quashes Treasury's Asset Freezing]]></title>

      <description><![CDATA[<p>In a High Court judgment today of the highest constitutional importance, Mr Justice Collins ordered that Government measures introduced to freeze terrorist assets were unlawful and should be struck down as they had not been authorised by Parliamment.</p>
]]></description>
      <content:encoded><![CDATA[<p>The measures contained in the Terrorism (United Nations Measures) Order 2006 and the Al-Qaida and Taliban (United Nations Measures) Order 2006 were introduced directly by the Government through Orders in Council to implement United Nations Security Council Resolutions to strengthen domestic controls on the financing of terrorism and to comply with the British Government’s international obligations to enforce UN Resolutions requiring such controls. They have never been scrutinised, debated or approved by Parliament.
In a judgment condemning as impermissible the Government’s ousting of Parliament Mr Justice Collins said:
“Counsel for the applicants have submitted that the means used to apply the obligations imposed by the UN Resolutions is unlawful. Parliament has been bypassed by the use of Orders in Council. But in deciding the appropriate way in which the obligation should be applied and in particular in creating the criminal offences set out in the Orders it was necessary that Parliamentary approval should be obtained. Those submissions are in my judgment entirely persuasive.”
<p>
The schemes give the Treasury far reaching powers to impose asset freezes on people they have reasonable grounds for suspecting “may be” terrorists or on those listed by the UN Security Council. The five British nationals bringing this challenge who have been designated under the Orders have had their assets frozen, are only allowed to access enough money to meet basic expenses, and are compelled to account to a civil servant for every penny they spend. They are subject to unprecedented levels of intrusion and control without end or review. They require permission for all economic activity, however modest. The complex regime governed by permissions and licences is not merely harsh but at points absurd. We have the madness of civil servants checking Tesco receipts, a child having to ask for a receipt every time it does a chore by running to the shops for a pint of milk and a neighbour possibly committing a criminal offence by lending a lawnmower.
<p>
None of the Applicants has been given proper reasons why they have been subjected to this oppressive and draconian regime by the State. None of them have convictions for terrorism and they all deny any links to terrrorism. The Orders introduce criminal offences for breaching these sanctions with a maximum penalty of 7 year imprisonment. An offence is commited not only if the designated person fails to comply with the restrictions but also if other people who have been notifed of their designation give them funds or economic resources.
<p>
In a February 2006 speech Gordon Brown, then Chancellor of the Exchequer, set out his vision for new measures to be implemented for the Treasury to become “a department for security”:
<p>

By being tough on security, with strengthened resources and powers, and tough on accountability, with safeguards for individuals and oversight through Parliament, we can make Britain safer and more secure while affirming our very British commitment to the liberties of the individual and showing we will never sacrifice the very values terrorism wishes to destroy.

<p>
The court ruling today has shown that the Government is willing to sacrifice the fundamental rights and liberties of its citizens, including the fundamental constitutional right that only Parliament can take away basic freedoms, when they think it convenient to do so. They have dishonoured their pledge of accountability and oversight through Parliament.

Mr Raissi was detained at Belmarsh prison for almost five months, before a judge dismissed the case and concluded there was no evidence to support the allegation that he was involved in terrorism. In 2004 Mr Raissi asked the Home Secretary for an ex gratia payment to compensate him for the ‘serious defaults’ of the Crown Prosecution Service (CPS) and the police, but this was refused. The High Court upheld this refusal in 2007, but last week the Court of Appeal allowed his judicial review and ordered the Home Secretary to reconsider his application. Lord Hooper said: ‘There is a considerable body of evidence to suggest that the police and the CPS were responsible for serious defaults.’ A CPS spokesman said it would be studying the issues raised but noted that the judgment ‘reaches no firm conclusion’ regarding the CPS.</p>

      <content:encoded><![CDATA[<p>Today the Court of Appeal said the words that Lotfi Raissi has waited six years to hear. The strongly worded judgement said “he has been completely exonerated” of the allegations of terrorism.<br />

The Court of Appeal allowed Lotfi Raissi’s Judicial review appeal and ordered the Home Secretary to reconsider his application for compensation for the ordeal he suffered, when he was falsely accused of training the 9/11 hijackers.
<br><br>
Lotfi Raissi, 33, an Algerian pilot, was the first person accused of participating in the attacks on the World Trade Centre and the Pentagon. He was arrested at his home in Colnbrook by the Anti-terrorist branch of the Metropolitan Police on 21 September 2001. Accused of being the ‘chief instructor’ to the terrorists, Mr Raissi found himself at the centre of the largest investigation in British criminal history. He was told that it was likely that he was going to be charged with conspiracy to murder and could face the death penalty in the US.<br />
<br><br>
These allegations resulted in Mr Raissi being detained in a cell for 23 hours a day at Belmarsh top security prison for almost five months.<br />
<br><br>
On 24 April 2002 the extradition nightmare concluded when a British judge dismissed the case and made a special point of highlighting Mr Raissi’s innocence, saying that there had been ‘no evidence’ whatsoever to support the allegation that Mr Raissi was involved in terrorism.
<br><br>
In June 2004 Mr Raissi wrote to the Home Secretary asking to be compensated under the Home Secretary’s ‘Ex Gratia Scheme’ for victims of miscarriages of justice. The scheme was intended to compensate those who have been detained in custody, in the UK, for the loss they have suffered when it can be shown that they are completely exonerated, or if the detention is the result of a serious default by a public authority. The then Home Secretary rejected Mr Raissi’s compensation claim and since that time Mr Raissi has sought to overturn this decision in the courts.<br />
<br><br>
The Court of Appeal today delivered a unanimous and uncompromising judgment in Mr Raissi’s favour. Lord Justice Hooper delivering the judgment of the court said:
<br><br>
&lt;quote/>
&quot;...it seems to us that the extradition proceedings themselves were a device to secure the appellant’s presence in the US for the purpose of investigating 9/11 rather than for the purpose of putting him on trial for non-disclosure offences. We also consider that the way in which the extradition proceedings were conducted in this country, with opposition to bail based on allegations which appear unfounded in evidence amounted to an abuse of process. The proceedings were used as a device to circumvent the rule of English law that a terrorist suspect could (at that time) be held without charge for only 7 days ... it appears that the proceedings were brought for an ulterior motive and that the opposition to bail, based on unsubstantiated assertions, was also an abuse. It does not appear to us that the CPS can be absolved from all responsibility for this state of affairs. The facts of this case, which we have set out in some detail, show how involved the police and the CPS were in the extradition proceedings.”

“There is also evidence that actions of the Metropolitan Police resulted in false statements being made to the courts contributing to the decision to refuse bail”.

“In conclusion, we consider that there is a considerable body of evidence to suggest that the police and the CPS were responsible for serious defaults. Of course, we do not reach firm conclusions on these points as the CPS and Police were not represented before this court and the findings of fact are for the respondent ... We are firmly of the view that there is sufficient evidence of serious default to require the respondent to reconsider his decision in the light of our ruling as to the scope of the scheme. That is a sufficient basis on which to conclude that this appeal should be allowed”.

&quot;Last Wednesday was another nail in the coffin of legal aid, when any resistance to signing the new criminal contract disintegrated.</p>

<p>The majority of firms in Manchester had no desire to sign up to a contract where it is unlikely we will be able to remain profitable, and that could only result in huge losses, cuts in service, cuts in staff and cuts in quality.</p>

<p>However, we felt very isolated despite firms in all the other urban areas voicing the same concerns as ourselves, but unable to take collective action because of the government’s anti-competition laws.</p>

<p>We have lost a significant opportunity to stand up to a government that has treated us with contempt, refusing to negotiate and cancelling meetings at the last minute for political reasons.</p>

<p>We are fighting with both hands tied behind our backs against the Legal Services Commission, which has no understanding of the legal aid market or the needs of business and in which the profession has lost all confidence.</p>

<p>We must ensure that, next time, we are better prepared to try and safeguard whatever remains of the hard-working, caring network of criminal defence lawyers or the state will be able to further suppress the weak and vulnerable in our society.&quot;</p>
