Failing to provide, failing to stop, careless driving

19 December 2003

Our client is a mobile caterer. She was charged with failing to provide a specimen of breath for analysis, failing to stop after an accident, failing to report an accident and driving without due care and attention following her crashing her car into a parked van in the early hours of the morning and fleeing the scene. The police arrested her at home about an hour later, when she was in a drunken state. She would have been disqualified for a minimum period of 12 months in the event of a conviction and would therefore have lost her job. We sent a letter to the prosecution challenging the fact that the intoxilyser operator was actually qualified as such. We promptly received a notice of discontinuance in relation to all charges!
