Failing to provide a breath specimen

Our client was charged with failing to provide a specimen of breath for analysis. He was a professional driver and if convicted would have been disqualified and lost his job. His defence from the outset was that the police had not give him the mandatory statutory warning as to the consequences of failing to provide a specimen. The prosecution obviously did not make any enquiries with the officers as they conceded this point at court and the charge was dismissed.
